Daily record of employees’ working hours

As of 12 May 2019, all businesses will have to submit a daily record of the working hours put in by their employees, which must include the exact start and end times of the working day of every team member. (RDL 8/2019, of 8 March. BOE 12/03/2019)

With respect to the recording of this information, businesses will be required to keep these records for four years, always remaining available to the workers themselves, their representatives and the Inspección de Trabajo y Seguridad Social (Employment and Social Security Inspectorate).

It is considered a serious offence to fail to hold a record of working hours, punishable by a fine of up to 6,250 euros (Article 7, section 5, of the Amended Labour Infringements and Penalties Law – LISOS).

This amendment notwithstanding, you are reminded that the obligation to maintain a register of overtime by each team member (Article 35.5 of the Employment Law) is still in force.
